买方提出索赔Buyers Lodge Claims

1、We are lodging a claim for shortage of weight.

We have substantial evidence for lodging a claim.

Such being the case, we are compelled to reserve the right to lodge a

claim against you.

We shall lodge a claim for all the losses incurred as a consequence of

you* **ilure to ship our order in time.

2、We have already made a careful investigation of the case.

Here is the survey report issued by China Commodity Inspection Bureau

which will surely support our mind.

The certificate shows very clearly that the goods are not packed properly.

Our investigation shows that damage was caused by improper packing.

Therefore we have to refer this matter to you.

The quality of your shipment for our order is not in conformity with the

agreed specifications. We must therefore lodge a claim against you.

There is a difference of 50 tons between the actual landed weight and

invoiced of this consignment.

We regret to inform you that the goods were underweight and we cannot

but file a lodge with you.

3、I’m afraid you should compensate us by 15% of the total amount.

With respect to inferior quality of your goods, we claim a compensation

of US$50,000.

I'm afraid you should compensate us by 5% of the total amount of the

contract.

We register a claim for US$200.

4、We hope that you will see your way to make up for the loss we

sustained.

you have suffered, so it is out of the question for us to consider it.

8. We regret to tell you that your claim cannot be entertained as it is

raised far beyond the time limit stipulated in the contract.

9. We regret that your claim on shortage cannot be accepted.

10. The damage was caused by rough handling when the goods were

being loaded on board ship at the dock.

Apologies for Goods not in Conformity with the Sample

Dear Sirs,

cross-checked at our forwarding department. It is the first case in all these

Claim for Improper Packing

Dear Sirs

We received you consignment of Cup made in China this morning.

However, on examining the contents we found the cases No.3 and No.8

are broken and several dozens of the cups inside them are seriously

Much to our regret, the above shipment arrived at your end with several

cups damaged as mentioned in your letter of July 2, 2002.

You may be aware that our cups have been sold in a number of markets

abroad for quite a long time, and all our customers have been satisfied

with our packing. Every shipment of our exports is strictly inspected by

our shipping department before loading, and each package is subject to a

careful examination, the goods under the above Sales Confirmation

XF2054L were in perfect condition when they were shipped, and

individual cases were clearly marked with “Handle With Care”, “Fragile”

and other necessary care clean B/L supports these facts after

going into the matter carefully, we presume that the damage might be due

to rough handling in transit or during unloading. Your claim should be

referred to the shipping company or the insurance company as the mishap

occurred after shipment or in uently we find no grounds to

compensate for the loss you claimed for.
