Patent Law of the People's Republic of China

Chapter I General Provisions

Article 1 This Law is enacted in accordance with the Constitution

for the purpose of promoting the development of science and

technology, encouraging the creation and use of inventions, raising

the level of invention utilization, protecting the legitimate rights

and interests of inventors and other patentees, as well as promoting

the progress and development of the socialist culture, economy and

science and technology.

Article 2 The State protects patent rights in accordance with law.

The patent right shall have the properties of personal and exclusive

rights as provided for by law.

Patent rights shall be protected by law, and it shall be forbidden to

infringe upon the patent right of another by manufacturing, using,

offering to sell, selling or importing the patented product, or using

the patented process, and it shall also be forbidden to use the

patented design. The scope of protection of a patent right shall be

determined by the scope of protection as set forth by its patent

claims.

Article 3 The administrative department for patent affairs of the

State Council shall be responsible for nationwide patent work.

Administrative departments for patent affairs under the people's

governments at or above the county level shall be responsible for

patent work within their respective administrative regions.
