NOTE These Instructions to TENDERERS(IT) wilL not be part of Purchase order and will cease to

have effect once the Purchase Order is signed and issued. 注意：投标者须知不属于订购单的一部分，在签发订购单后失效

IT1 Scope of Tender &Source of Funds招标范围和资金来源

1.1scope of Tender招标范围

C .E .O GENCO一II TPS GUDDU(hereinafter cabled "The Employer" wishes to receive tender for

Hiring of Internationally reputed and experienced independent engineer(s) to determine the

Benchmark Performance Parameters of Heat rate，Annual Availability. Dependable Capacity，Reliability and the baseline multi-year tariff of all blocks of Thermal Power Station，Cuddu

CEO GENCO-II TPS GUDDU（下文称为招标者）面向国际知名工程师，给Guddu热电厂机组的热容量，年可用小时数，可靠容量，安全性，多年费用基线等性能参数做评测

1.2Source of Funds资金来源

The Employer has arranged the funds from PEPCU'S own resources of Foreign Exchange allocated to

G.M.(Thermal)for Hiring services for major overhauling.

招标人已得到隶属于通用公司的PEPCO公司的国际交易资金，用于付这次大修的服务费用

IT2 Eligible Tenderers投标资格

Tendering is open to all firms who are bona-fide Specialists firm

should have proper equipment and a team of qualified&experienced world renowned experts to carry

out such services mentioned in SCHEDULE TO TENDER/SCOPE OF WORK.

本次投标面向本行业的各资深专家顾问，投标公司应拥有能提供在招标行程及工程范围里提到的各项服务的设备及资深专家团队。

IT3 Cost of Tendering投标成本

The tenderer shall bear all costs associated with the preparation and submission of its tender and the

Employer will in no case be responsible or liable for those costs，regardless of the conduct or outcome

of the tendering process

投标人应承担在投标准备阶段及完成任务期间的相关费用，招标人在此期间不对这些费用负责。

IT5 Clarification of Tender Documents投标文件澄清

5.1 A prospective tenderer requiring any clarification（s） in respect of the Tender Documents may

notify the Emplpyer’s address given here in below：

准投标者若需要投标文件澄清可以通过以下方式与招标人联系获取：

5.2 The employer will respond to any request for clarification which it receives earlier than 15 days

prior to the deadline for the submission of of the employer‘s response will be for

warded to all prospective tenderers，at least 7days prior to deadline for the submission of tenders，who

have purchased the Tender Documents including a description of the enquiry but without identifying

its source。

招标单位将会对在招标截止前15天索取投标文件澄清作出回应，招标文件或其复印件最迟将在投标截止前7天寄出。副本看老板的反应将提交给所有的人,发出的招标文件，包括描述了调查，但没有查明其来源。

IT6 Amendment of Tender Documents投标文件的修改

6.1 At any time prior to the deadline for submission of tenders ，the employer may ，for any reason ，whether at his own initiative or in response to a clarification requested by a prospective tenderers，

modify the Tender Documents by issuing an amendment

在提交标书最后期限前，业主可根据自己的意愿，或应回复潜在投标者的解释文件的要求，发布附录修改投标文件。

6.2 Any amendment thus issued shall be part of the Tender Documents pursuant to sub

Clause6.1hereof ，and shall be communicated in writing to all pursuant to the Tender

ctive tenders shall acknowledge receipt of each amendment in writing to the

employer

根据6.1，对投标文件的任何修改仍属于投标文件并应按照与投标文件相关内容或格式载入。准投标者应以书面形式向招标单位表示已收到关于投标文件有所修改的通知

6.3To afford prospective tenderers reasonable time in which to take an amendment into account in

preparing their tenders ，the Employer may at its discretion extend the deadline for submission of

tenders

考虑修改投标文件后时间有所变动，招标单位将会适当延长提交标书的截止日期

C PREPARATION OF TENDERS投标准备

IT7 language of tender 投标语言

7.1 the tender prepared by the tenderers and all correspondence and documents relating to the

tender ，exchanged by the tenderer and the employer shall be written in the English language，provided that any printed literature furnished by the tenderers may be written another language so long

as accompanied by an English translation of its pertinent passages in which case，for purposes of

interpretation of the Tender ，the English translation shall be govern

招标过程的组织及相关文件的准备由招标单位提供，投标者与招标单位将用英语交流，投标者标书中的一些辅助文件或小册子可使用另外的语言，但与投标有关的段落要有英语译文。在标书翻译时，以英文为准

IT8 documents comprising the tender标书的组成文件

8.1The tender prepared by the tenderer shall comprise the following components：投标者准备的标书应包括以下几部件

a． covering letter附信

b. form of tender duly filled，signed and sealed标书的正式填写，签署，密封格式

C. schedules to tender duly filled and initiated ，in accordance with the instructions contained therein

标书正式填写及生效的日程安排和其中包含的说明书

D. tender security投标保证书

IT9 Sufficiency of Tender投标的充分性

9.1 Each tenderer shall satisfy himself before Tendering as to the correctness and sufficiency of

his Tender and of the rates and prices entered in the Price Schedule, which rates and prices shall

except in so far as it is otherwise expressly provided in Contract/Purchase Order， cover all his

obligations under the Contract/Purchase Order and all matters and things necessary for the

proper Supply of Goods/Spares

每位投标者应该确保其标书的正确性及其充分性并接受费用预算表所确定的费率与价格，这些费率与价格不包括合同或订购单里明文规定的费率与价格，包括了投标人在履行合同或订购单

里的义务和工程过程所需的一些必要物件及零件的费用。

9.2The tenderer is advised to obtain for himself at his own cost and responsibility

all information that may be necessary for preparing the tender and entering into contract for

execution of the work /supply of goods/spares. .

招标人应承担参加投标或在合同准备过程所需的一些费用

IT-10 . Tender Price, currency of Tender.& Payment 标价，投标的支付货币

10.1 The tenderer shall fill up the Schedule of Price indicating the unit rates and prices of the goods

to be supplied underline contract/purchase order.

对单价和总价未标明的项目，在工程中业主不予以支付，其价格视作已包括在工程量表中其他的单价、总价中。 .

10.2 Unless otherwise stipulated in the Conditions of Contract，prices quoted by the tenderer shall

remain fix during the tenderers .performance of the Contract and not subject to variation on any

account.

除非合同中另有明确规定，合同包括条款一所述全部工程，以投标者提供的项目单价和总价为基础

IT-11Tender Security 投标保证

11.1 Each tenderer shall furnish, as part of his tender, a Tender Security in the amount equal to

2% of the Tender price in the form of Deposit at call or a Bank Guarantee issued by a Scheduled

Bank in Pakistan in favour of the Employer valid for a period 30 days beyond the tender Validity date.

投标者应随其标书提交一份投标保函，金额不少于投标价格的２％。在标书生效30天前，以活期存款或以巴基斯坦预算银行作担保形式交到招标单位。

11.2 Any tender not. accompanied by an acceptable Tender Security shall be rejected by the

Employer as non-responsive 任何未附可接受的投标保函的标书都将被招标单位拒绝

11.3 The .tender securities of unsuccessful tenderers will be returned upon award of contract to

the successful tenderer or on the expiry of validity of Tender Security whichever is earlier.

不成功的标书的投标保函将尽快返还，不迟于标书有效期结束前

11.4 The Tender Security of the successful tenderer will be returned when the tenderer has furnished

the required performance Security.

成功的投标者的投标保函将在其开始进行工程和按要求提供履约保函后返还.

11.5 The Tender Security may be forfeited 投标保函在下列情况将失去

a. If a tenderer withdraws his tender during the period of render validity，

投标者在标书有效期内撤标

b. In the case of a successful tenderer if he fails to：

i. Furnish the required Performance Security.

ii. Sign the Contract . Agreement/Acknowledgement of purchase order/service order.

11.6 The Tender Security and Performance Security shall be furnished on non-judicial paper of value

prescribed by the Govt. of Pakistan. 投标保证金和履约基金应按巴基斯坦政府所规定的非司法文件形式签署

TY OF SIGNING AND SUBMISSION OF TENDERS 有效签署及提交标书

12.1 Tenders shall remain valid for the period of. 1 80 days after the date of Tender opening.

从特定的投标结束期起６个月内投标书保持有效且可供接受

12.2 In exceptional circumstances, the Employer may request the Tenderers to extend .the period

of validity for a specific period The request and responses thereto shall be made in writing. A

Tenderer may refuse the request without forfeiture of his Tender Security. A Tenderer

agreeing .to. the request will not be required. or permitted. to modify his Tender, but will be required

to extend the validity of his Tender Security for the period of all tension and in compliance with

Clause IT-11 in all respect.

在特殊条件下，在原标书有效期结束前，业主或其代理人可要求投标者延长其标书有效期。业主的要求和投标者的答复均应是书面的形式。投标者可以拒绝这样的要求，且不会因此失去其投标保函。答应这样要求的投标者不得改动其标书，但被要求顺延其投标保函有效期。条款IT11中有关投标保函的返还和失去的规定同样适用于延长期。

12.3 Tenderers are particularly directed that amount entered on the form of Tender for performing. the

contract shall be strictly in accordance with the Tender documents.

投标者应严格按照招标文件所要求的文件格式及数量签署合同

12.4 Each Tenderer shall prepare one original and one copy or the Documents comprising the Tender

and clearly mark them ORIGINAL and COPY as appropriate.

投标者应准备条款十（一）规定的标书的一个原本和两个副本，并分别注明“原本”和“副本”。

In the event of discrepancy between them the Original shall prevail.

如果两者之间有不同，以原本为准。

12.5The original and copy of the Tender shall be typed or written in indelible ink and shall be signed

by the person or person(s) duly Authorized to sign. In the case of copies, Photostats are also

acceptable. This shall be indicated by submitting a written power of attorney authorizing the

signatory of the Tenderer. to act for and on behalf of Tenderer. All pages of Tender shall .be

initialed and stamped by the person or persons signing the Tender标书原本和两个副本应打字或用不能抹掉的墨水书就，并由一名或多名有权责成投标者遵守合同的人士签字。与标书一起应有一份书面委托书用以证明授权。写有条目和修订内容的每一页标书都要有在标书上签字人士的缩写签名。

12.6 Tenderer can quote for an item or items 投标者可适当增加条目

12.7 No alternation is to be made in the. form of Tender nor in the schedule thereto except in filling.

with, the Tender maybe rejected全套标书不应有改动，擅自改动标书的投标将会被退回拒绝

12.8 . Tenderer shall indicate in the space provided in the form of Tender, their full and proper

address at which notices may be legally served to them and to which all correspondences in

Connection with their Tenders and contract are to be sent. 投标者应在标书所对应空间填写好自己的通信地址，以确保招标单位的文件传送

12.9 Tender shall retain a copy of Tender documents as their file copy

投标者应保留一份标书文件备份

12. 10 The Tender shall contain no alterations omissions or additions except to comply with

the instructions issued by the Employer or as are necessary to correct errors made by the Tenderers in

which case such corrections shall be initialed by the person or persons signing the Tender. 全套标书不应有改动、行间书写或涂抹的地方，除非按议程的指示或为改正投标者的错误，但这种情况下改正的地方应有在标书上签字人士的缩写签名。

12.11 Schedule of technical data attached with the Tender schedule must accompany the Tender duty

filled in signed and stamped by the Tenderers otherwise the offer will be considered

incomplete'/rejected

在标书附表中的技术参数表必须应有投标者的盖章或签名，否则将视为无效或未完成

12.12All schedules to Tender are to be properly completed and signed

给招标单位的工程进度表应正确填写好

12.13The Tender shall be delivered in person or sent by registered mail at the address of the

Employer.

招标单位将会以书信或电子邮件方式发送标书

12.14 Each Tenderer shall submit his Tender as under投标者按以下规定提交标书

i. ORIGINAL and each COPY of the tender shall be separately sealed and pu tin separate

envelopes and marked as such. 投标者应把标书原本和每个副本分别各装入一个内信封和一个外信封，且在信封上注明“原本”、“副本”。 '

ii. The envelopes containing the ORIGINAl and CPOIES will be put in one sealed envelopes and

addressed/ identified.装有原本及副本的两信封在装在一个信封后表面地址或记号

12.15 The inner and outer envelopes shall内外信封均应注明：

a) be addressed to the Employer at the address given in subclause5.1条目 5.1提及的地址

b) Bear the Tender No. and date of opening of Tender注明标书号码及开标日期

c) Provide a warning not to open before the time and date for Tender opening. 注明请勿在开标前拆开 .

12.16 . lf the outer envelopes is not sealed and marked as Employer will assume no

responsibility for the misplacement or premature opening of the Tender Deadline for Submission, 如果外信封未按规定注明有关事项，一旦标书被错误处置或提前打开，招标单位对此不负任何责任。提前打开的标书将被招标单位拒绝，予以退回。

cation & withdrawal of Tenders. 标书修改和撤销

13.1(a)Tenders must be received by the Employer at the address specified in the subclause5.1

not later than the time and date stipulated in INVITATION TO TENDERERS/TENDERING

DATA标书应在招标数据书中提及的日期之前提交准确提交到条目5.1的招标人地址

13.1(b)Tenders with charges payable will not be acceptable nor will arrangements an undertaken

to collect the Tenders from any delivery point other than that specified above. Tenderers shall bear

all expenses incurred in the preparation and delivery of Tenders.

除上边规定外，没付标书费用的投标者将得不到相应标书。 投标者应承担准备和寄送标书的一切费用。

13.1(a)Where delivery of a Tender is by mail and Tenderer wishes to receive an

acknowledgement of receipt of such Tender, he shall make a request for such acknowledge in a

separate letter attached to but not included in the sealed Tender package. 想以电子邮件方式接受标书的投标者应用独立信件表明，并粘附预密封标书文件外

13.1(d)Upon request acknowledgement of receipt of Tender will be provided to those making

delivery in persons or by messenger以上要求的标书传递方式将通知到相关传送人员

13.2 Tenders submitted through telegraph telex fax or e-main shall not be considered.以电报，传真或邮件提交的的标书将视为无效 .

13.3Any Tender received by the Employer after the date and time of Tender submission

will be returned unopened to such Tenderer Delays in mail, delays of person in transit or delivery of a

Tender to the wrong office shall not be accepted as an excuse for failure to deliver a Tender

at the proper place and time. It shall be the Tenderers responsibility to determine the manner

in which timely delivery of this Tender will be accomplished either in person by messenger or by mail

在提交日期之后才被招标单位收到的标书将会原件退回，不接受任何解释。投标者应注意选择正确方式，确保标书准时提交。

13.4 Any Tenderer may modify or withdraw his Tender submission provided that written

notice of the modification, substitution or withdrawal is received by the Employer prior to the

deadline for Submission of Tenders 投标者在提交标书后可对其进行修改或予以撤销，只要修改文件和撤标通知在提交标书最后期限前送达招标单位。

13.5The notice for modification substitution or withdrawal of any Tender shall be prepared sealed

marked and delivered in accordance with the provision of Clause IT-12 with the outer and inner

envelopes additionally marked MODIFICATION SUBSTIT UTION or WITHDRAWA as

appropriated ， A withdrawal notice may also be sent by telex or fax but followed by signed

confirmation copy post marked not later than the deadline for submission of Tenders投标者的修改文件或撤标通知应按有关提交标书条款（参照条目IT12）的规定准备、封缄、标记和发出。撤标通知可以通过电传、电报送达，但随后应提交一份有签名的确认件，且其邮戳上日期不能晚于提交标书最后期限。

13.6 No Tender may be modified by a Tenderer after the deadline for submission of Tenders

Withdrawal of a Tender during the interval between the deadline for submission of Tenders and

the expiration of the period of Tender validity specified in the form of Tender may result in forfeiture

of the Tender Security标书提交截止日期后，投标者无法修改标书内容。在提交标书最后期限和标书有效期满之间的时间撤标将按条标书中的规定失去投标保证书。

13.7The Employer may at his discretion extend the dead line for submission of Tenders by issuing an

addendum in accordance with Clause IT 6 in which case all rights and obligations of the Employer

and the Tenderers previously subject to the original deadline will there after be subject to the deadline

as extended招标单位可通过发布条款IT16规定的附录延长提交标书的最后期限，但至少应在原期限前七天通过电传或电报通知所有已索取投标文件的具有资格的投标者。在此情况下，所有原期限下业主和投标者的权利义务顺延至新期限结束。

E TENDER OPENING AND EVALUATION 开标和评标

14.1 TENDER OPENJNG & CLARIFICATION AND EVALUATION 开标,澄清和评标

14.1 A committee consisting of nominated members by the Employer will open the

Tenders ,including withdrawals and modifications made pursuant to Clause IT13 in the presence of

Tenderers’ Representatives who choose to attend at the time, date and location stipulated in the

invitation to Tenderers and Tendering data. The Tenderers Representatives who are present shall sign

in a register evidencing their attendance 招标单位将派出专业人员的团队在投标代表面前拆开标书，投标代表可按照招标文件里所提到的日期参加开标会议，届时将登记出席代表名单

14.2 Envelopes marked MODIFICATIONS SUBSTITUTION or WITHDRAWAL shall be

opened and read out first along with the name of the Tenderer. Tenders for which an acceptable

notice of withdrawal has been submitted pursuant to ClauseIT13 shall not be opened有修改，代替，撤回的文件将随其投标者名字提前宣布，条款IT13所提及到的特殊情况投标者除外

14.3 The Tenderets name Tender prices any discount arid price of any alterative proposal (s) the

presence or absence of Tender security and such other details as the Employer at its discretion may

consider appropriate will be announced by the Employer at the tender opening. 在开标时将宣布投标者姓名、投标价格及修订、投标保证书、撤标通知（如果有）以及其他业主或其代理人认为适宜宣布的事项

Any Tender price or discount which is not read out and recorded at Tender opening will not be taken

into account in the evaluation of Tender. 在开标会议未提及的价格改动将默认为不会在招标评估中不予采纳

Discounts offered for lesser period than the Tender validity shall not be considered in evaluation在标书有效期内的短期时间的折扣在评标中不予以考虑。

14.4 CORRECTION OF ERRORS 错误更正

a) Prior to the detailed evaluation pursuant to Sub-Clause 14.10 hereof, the Employer will determine

the substantial responsiveness of each Tender to the Tender Documents.在条款14.10的评标细节前，招标单位将检查各标书上的标书文件

For purpose of these clauses a substantially responsive Tender is one which conforms to all the terms

and conditions of the Tender Documents without material deviations 这些步骤的目的在于减少标书文件的资料性偏差

A material deviation or reservation is one:关于资料的偏差或保留如：

i) Which affect in any substantial way the scope quality or performance of the Works对工程质量或性能的有实质影响

ii) Which limits in any substantial Way inconsistent with the Tender Documents ,the Employer’s

right or the Tenderers obligations under the Contract对合同中业主的权利和投标者的义务有实质性限制

iii) Whose rectification would affect unfairly the competitive position of other Tenderers presenting

substantially responsive Tenders纠正这样的偏差或保留，将对其他提交符合要求的标书的投资者的竞争力有不公正的影响

The Employers determination of a Tender responsiveness will be based on the contents of the Tender

without recourse to extrinsic evidence在详细的评标前，招标单位将判定每份标书是否符合投标文件的要求

b) Arithmetic errors will be rectified on the following basis以下数学计算方面错误将由招标单位改正

If there is a discrepancy between the unit price and total price that is obtained by

multiplying the unit price and quantity ,the unit price shall prevail and the total price

shall be corrected if there is a discrepancy between the words and figures the amount in words shall

prevail. If there is a discrepancy between the total Tender Price entered in Form of Tender and the

total shown in Schedule of prices Summary the amount stated in the Form of Tender will be corrected

by the Employer in accordance with the Corrected Schedule of Prices .If the Tenderer does not accept

the corrected amount of Tender his Tender will be rejected and his Tender Security forfeited

当数字与文字表示的数额不同时，以文字表示为准，除非文中明确以数字表示为准；当单价和以单价乘以数量得到的总价不同时，以单价报价为准，除非业主认为单价存在严重错误，在这样的情况下，以总价报价为准，改正单价错误。如果投标者认为更正的数额会给其造成困难，可撤标。不过撤标使投标者面临失去投标保证书的危险。

14.5 To assist in the examination evaluation and comparison of Tenders the Employer may at its

discretion ask the Tenderer for a clarification of its Tender .The request for clarification and the

response shall be in writing and no Change in the price or substance of the Tender shall be sought

offered or permitted为了帮助检查、评价和比较标书，招标公司可要求投标者就其标书作出解释，包括单位价格细目表。提出解释要求和相应的回答均应是书面的，不得对价格或其他标书要素进行修改。

14.6 A) Preliminary Examination and determination of responsiveness of Tenders判定标书是否符合要求

Prior to determination of responsiveness the Employer will examine the Tenders to determine

whether：在详细的评标前，招标单位将判定每份标书是否符合投标文件的要求：

a) The Tender is complete and does not deviate from the scope 标书完整且没跑题

b) Any computational errors have been made 计算方面错误已处理好

c) Requisite sureties have been furnished 有相应的担保

d) The documents have been properly signed 文件合理签署

e) The Tender is valid till required period 在规定期间标书有效

f) The Tender prices are firm during currency of contract 在合同期间标价稳定

g) Delivery period offered is within specified limits 在规定时间内提交标书

h) The Tenderer / manufacturer is eligible to Tender and possess the requisite experience

投标单位有资料参投并有丰富的经验

i) The Tender does not deviate from basic technical requirements and标书不偏离基本技术要求

j) The Tenders are generally in order 一般来说，标书按顺序排列

B) A Tender is likely not be considered 这样的标书有可能被拒绝

i It’s a received after the time and date fixed for its receipt 超时收到

ii It is submitted through fax telegram telex or email 通过传真或邮件方式寄送

iii/ lt is not accompanied with Tender security 不符合标书保证

iv lt is unsigned 未签署

v It indicates that prices are not firm during currency of the contract 在合同期间标价不稳定

vi The Tenderer refuses to accept arithmetic corrections投标者拒绝接受数学计算方面错误的改正

vii It is materially and substantially different from the condition/ specifications of the Tender

document与投标文件里要求的条件或规格相差甚远

validity is less than specified 标书有效性未达到要求

14.7 A Tender determined as substantially non-responsiveness will be rejected and will not

subsequently be made responsive by the Tenderer by correction of the non-conformity 没有对其标书中所出现错误进行更改的标书将会被拒绝

14.8 Any minor informality or non-conformity or irregularity in a Tender which does not constitute a

material deviation may be waived by Employer provided such waiver does not prejudice or affect the

relative ranking of any Tenderer 有较小的非正式或不合格不构成资料偏差错误的标书将会被推迟，但这种推迟并不妨碍投标者相对名次

14.9 Conversion to Single Currency换算成一种货币

To facilitate evaluation and comparison the Employer will convert all Tender Prices

expressed in the amount in various currencies in which Tender Price is payable to Pak.

Rupees at the Telegraphic Transfer and Over Draft (TT&OD) composite exchange rates (selling)

published by State Bank of Pakistan applicable to similar transactions on the date of the opening of

Tenders为了评价和比较标书，业主可把不同货币表示的数额（不包括临时费用，但包括加班费）以巴基斯坦国家银行开标日巴基斯坦卢比卖出价将其换算成相应货币。

i) Tender will be evaluated for each item of the scope of work工程范围的各项条款会被估价

ii) The evaluated Tender price shall be arrived at ,on the following basis：投标价格评估将以下为基础：

Besides the read out prices， the responsive Tenders shall be evaluated in detail taking into account

the technical and commercial deviations

除了以上提及价格，应在考虑技术和商业上的偏差之后对投标价格作出详细评估

14.10 Detailed Evaluation of Tenders 标书具体评估

14.10.1 The Employer will evaluate and compare only the Tenders previously determined to be

substantially responsive pursuant to sub-clause 14.6 as per requirements given therein招标单位只评价和比较那些被判定符合投标文件要求的标书

14.10.2 Evaluation and Comparison of Tenders评价和比较标书

a) Tenders shall be evaluated for each item 标书的每一条款都会得到评估

b) The prices shall be compared on the basis of the evaluated在评估基础上，对价格进行对比

Tender prices pursuant to Para (c) herein below 标价按c段有关规定定价

c) TECHNIAL EVALUATION 技术评估

It will be examined in detail whether the Goods offered by the Tenderers complies with the

technical provisions of the Tender documents .Tenders containing the material deviations in

technical specifications shall be liable for the rejection of Tender 检查投标方所用材料是否符合投标文件里头的技术要求。标书中出现技术规范中的材料偏差将会被撤回拒绝

d) COMMERCIAL EVALUATION 商业评估

It will be examined in detail whether the Tender comply with the commercial /contractual conditions

of Tender Documents. 检查投标方是否符合投标文件里头的商业要求

It is expected that no major deviations/stipulations shall be taken by the Tenderer.投标方不应出现重大的偏差或规范错误

e) EVALUATED TENDER PRICE投标价格评估

In evaluating the Tenders, the Employer will determine for each Tender in addition to the Tender

price, the following factors (adjustments) in the manner and to the extent indicated below

to determine the Tender price在评标中，招标单位通过下列对报价的调整，确定每份标书的投标价格

1) Making any correction for errors pursuant to sub-clause14.4hereof按条款14.1改正错误

2) Making any appropriate price adjustment for any other variation or deviation. 对在标书价格其他数量变更、偏差或替代报价进行适当的调整；

3) Making an appropriate price adjustment for deviations in terms of payments (if any and

acceptable to the Employer) 对在标书价格和上述调整中未得到反映的条款变更，将对报价进行适当的调整；

14.11 Evaluation Methods 评估方法

Pursuant to sub-clause 14.10.2 Para(e) following evaluation methods for price adjustment will be

followed 根据条款14.10.2,，对标价调整后的评估方法如下：

Adjustment for Technical Compliance 为达到技术要求所做的标价调整

The cost of making good any deficiency resulting from technical non compliance will be added

to the corrected total price for comparison purpose only .The adjustments will be applied taking the

highest price quoted by other Tenderers being evaluated in detail in their original Tenders for

corresponding item . In case of non-availability of price from other Tenderers, the price will be

estimated by the Employer 为补足因技术欠缺而引起的差额，只添加到总价修正中作为比较。价格调整针对其他报价最高且标书已受检的投标人。价格改动由招标单位决定以防与其他投标人价格发生冲突

Adjustment for Commercial compliance为达到商业要求所做的标价调整

The cost of making good any deficiency resulting from any quantifiable variation and

deviations from the Tender schedules and conditions of contract, as determined b the

Employer will be added to the correct total Tender price for comparison purpose

only .Adjustment for commercial compliance will be added to the corrected total Tender prices

因变更，修正标书进度表或合同条件而引起的差额，只添加到总价修正中作为比较。为达到商业要求所做的标价调整将增加到总价上

3 .Adjustment for Deviation in terms of payment 付款过程偏差的调整

If any Tender deviates from the terms of payment/payment conditions as specified in the

conditions of contract and if such deviation is considered acceptable to the Employer，

markup earned for any earlier payments involved in terms outlined in the Tender as compared to those

stipulated in the conditions of contract shall be calculated at the scheduled bank rate per annum plus

three percent (3%) 如果标书偏离了合同所要求的付款条件但可以被招标方接受，比合同内的付款条件跟早的付款，将在指定银行的年利率基础上加3%

IT-15Process to be confidential过程保密

15.1 Subject to clause IT145 heretofore no Tenderer shall contact Employer on any matter

relating to its Tender from the time of Tender opening to the time the contract is award

在公开开标后，在向成功投标者授标前，有关对标书的检查、解释、评估及比较以及对授标的建议等信息不应让投标者或其他与评标过程无关的人士知晓。

15.2 Any effort by a Tenderer to influence Employer in the Tender evaluation Tender

comparison or Contract Award decisions may his Tender如果投标者试图在此过程中对业主施加影响，其投标将被拒绝。

F AWARD OF CONTRACT、授标标准

IT-16Post-Qualification 资格获取

16.1 In the absence of prequalification, the Employer will determine to its satisfaction whether

the substantially responsive lowest evaluated Tender is qualified to satisfactorily perform the

Contact 对未进行资格预审的投标单位，招标方将质疑其执行合同的能力

16.2 The determination will take into account the Tender’s financial and technical capabilities. It

will be based upon an examination of the documentary evidence of the Tenderers qualifications

submitted as well as such other information as the Ernployer deems necessary and appropriate 招标方将会根据投标方各项资格认证及其他相关信息，判断投标方的财务及技术能力

16.3 An affirmative determination will be prerequisite forward of the contract /issuance of

purchase order to the Tenderer. A negative determination will result in rejection of the Tenderers

Tender, in which event Employer will proceed to the next lowest evaluated Tender to undertake a

similar determination of the Tenderer’s capabilities to perform the contract satisfactory审查先从合同里的采购单开始，审查差评将影响投标结果，一旦出现这种情况，招标方将先对评价后价格最低的投标方开始，对其做资格评审

IT-17Award Criteria & Employer’s Right 中标标准&招标方权利

17.1 Subject to the sub-clauseIT17.2 the Employer will award the contract to the Tenderer whose

Tender has been determined to be substantially responsive to the Tender Documents and who has

offered the lowest evaluated Tender Price for the item provided that such Tenderer has been

determined to be qualified to satisfactory perform the Contract in accordance with the

provisions of Clause IT16 按条款17.1招标方将把合同交给标书符合投标文件的要求，且按条款16（如果适用）评价后价格最低的投标者，且该投标者有能力和资源来有效执行合同。

17.2 Not with standing Sub-clause IT19.1, The Employer reserves the right to accept or

reject any Tender, and to annual the Tendering process and reject all Tenders, at any time

prior to award of Contract, without thereby incurring any liability to the affected Tenderers or any

obligation to inform the affected Tenderers of the grounds for the Employer’s action IT-18Notification尽管有条款IT19.1业主保留以下权利：接受或拒绝任何标书；在授标前任何时候取消招标，拒绝所有标书，且对因此受影响的投标者不负任何责任，也无义务告知投标者他的行为动机。

cation of Award &Signing of Contract Agreement 授标通知&签订合同

18.1Prior to expiration of the period of Tender validity prescribed by the Employer, the Employer will

notify the successful Tenderer in writing (Letter of intent) that his Tender has been accepted在业主规定的标书有效期结束前，业主将用电传或电报（事后用挂号信书面确认）通知成功的投标者其标书已被接受挂号信（合同条款中称作“接受证书”）中应明确业主在考虑工程建设、完成及维修等因素后将支付给承包人的款额（合同条款中称作“投标额”）。

18.2 After furnishing of acceptable performance Security, the Employer will issue the purchase

order 招标单位将在收到履约保证金之后签署订购单

18.3 The formal agreement between the Employer and the successful Tenderer shall be ex within

seven (07) days of receipt of the form of contract agreement by the successful Tenderer from

the Employer.成功投标者收到的承包合同之后7天之内，将与招标方签订正式合同

18.4 Notwithstanding sub-clause 18.2 18.3 after furnishing of acceptable performance

security, the Employer will issue the purchase order thereafter 尽管有条款18.2和18.3,，招标单位将在收到投标者提供的履约保证金之后签署订购单

18.5 The supplier will acknowledge the acceptance of purchase order with 07 days after the date

thereof. 供货商将在合同签署的7天之后确认订购单

IT-19Performance Security 履约保函

19.1 The successful Tenderer shall furnish to the Employer a Performance Security

in the form and the amount stipulated in the Conditions of Contract within a period of 30 days from

the date of issuance of Letter of Intent在签署意向书后30天内，成功投标者应按合同条款向业主提交一份保函，保证将执行合同。

19.2 Failure of the successful Tenderer to comply with the requirements of Sub-clauses

IT18.2& 18.3 applicable or clause 19.1 shall constitute sufficient grounds for the annulment of the

award and forfeiture of the Tender Security如果成功投标者未遵守条款18.2、18.3的要求，将构成充足理由使业主取消对其授标，投标者还将失去投标保证书。

IT-20Alternate Proposal by Tenderer 投标者备用方案

20.1 Should any Tenderer consider that he can offer any advantage to the Employer by a

modification to the design or specification, he may in addition to his Tender to be submitted in

strict compliance with the Tender documents, submit alternate proposal(s) containing

如果投标者能提供更好的设计方案或技术，可在投标文件中详细列出，包括：

(a) relevant design calculation 相关设计计算

(b) technical specifications 技术规范

(c) any other relevant details /condition provided always that the total sum entered on the form of

Tender shall be that which represent complete compliance with the Tender Documents 提交备用标书文件时，应保证投标文件总量的完整性

20.2 Alternate proposal ，if any ， of the lowest evaluated responsive Tenderer only may be

considered by the Employer as the basis for award of Contract to such Tenderer 备用方案，如果有的话，将视为和评价最低的投标者签订合约的条件之一

IT-21Employer’s right to vary quantities 招标单位可更改的数量

21.1 Employer reserves the right at the time of award of contract to increase or decrease by up to

15% the quantity of Goods and services specified in the schedule of prices without any chance in the

unit rate or other terms and conditions 招标单位有权在签订合同时，增加或减少总物品和价格的15%的数量

21.2The Employer reserves the right to delete any item (s) before placing purchase order 在发出订购单之前，招标单位可随意更改各项条款

IT-22 Instruction not part of contract 合同之外的说明

22.1 Tenders shall be prepared and submitted in accordance with these instructions which are

provided to assist Tenderers in preparing the Tenders and do not constitute part of the Tender or

the contract document /purchase order. 以下说明仅用于帮助投标者更好的参加投标，并不属于投标文件或订购单
